Big difference Between Fault and No-fault Divorce in Michigan

So, you've heard of no fault insurance, but have you heard of "no fault" Divorce? No-fault Divorce is the law in Michigan also governs how a Divorce is handled. Simply stated, all those things has to be alleged during a Divorce complaint is "that might a breakdown of the marriage relationship up to the objects of matrimony that were destroyed and there income no reasonable likelihood is your marriage can be preserved".

I that will sounds like a mouthful as well as legalese. In its the fundamental principles terms, this means that not party is legally at fault for the Divorce. We may not allege why the marriage stopped working in the complaint, this there was a overview of the marriage. We may not allege infidelity, drug puzzle, gambling problems, or much of anything. If one spouse would really like a Divorce, the Divorce will probably be granted.

No fault means that if you want the Divorce, but your spouse does not want the Divorce, then you need to be granted a Divorce. Provided that you allege that there "has been a dysfunction in the marriage" then your spouse cannot contest that. They can contest property division, spousal support, and custody.

However, just because Michigan is generally a "no fault Divorce" city and state, that doesn't mean fault will never also come in. In Michigan, it is presumed your property division will be divided 50/50 is amongst parties. Now if one spouse has cheated on the other instrument, has a drug the problem, gambling problem, etc. that caused the other spouse to submit Divorce, fault can be. So the property division they are just plain 45/55, 40/60, 30/70, or inspite of the court may decide.

In enactment, fault can come into play when purchasing child custody. Fault, or moral fitness, can't be used as being a definite sole factor for deciding guardianship or parenting time but quite a few as a factor to come up with that determination. Other factors including who can best are supported by the child, how long your kids has lived in a steady environment, emotional ties amongst the child and the custodial parent, how permanent the home have to be for the child, physical and mental health of the a mother or father, preference of the the particular, school or home record of child, violence in the family unit, or any other thing to consider the court chooses to discover.

So legally, Michigan is a no-fault Divorce State when whining for Divorce and we does not have to allege why there typically a breakdown in the marriage ceremony, simply that there became a breakdown.
